About Workers Compensation

Workers’ Compensation —better known as ‘workers’ comp— is a form of insurance companies acquire in order to provide remunerations and benefits for those employees that become injured exclusively on their work site while performing their labor. This insurance is mandated by the United States government; the only state that does not require it is Texas. Workers that become injured or ill at work would receive partial salary replacement, compensation for healthcare treatment, and cash benefits upon evaluation from the Workers’ Compensation board and licensed medical doctors.

Having workers’ comp is a win-win

Acquiring this type of insurace, as stated before, provides multiple benefits for those workers injured from direct result of their jobs, however, workers waive their right of suing the company for negligence and/or transgresions. In other words, employees get their benefits and employers prevent lawsuits.

Eligibility

Usually independent contractors and entrepeneurs do not qualify for workers’ compensation insurance; only salaried employees would opt for it.

Coverages A & B

Coverage A: States the minimun remunaration for an employee. These include rehabilitation, medical expenses, salary replacement benefits, and death benefits. Except for the state of Texas, all states offer these perks depending on eligibility and specific cases.

Coverage B: Offers everything stated in Coverage A, however, Coverage B would provide for further needs the employee might require as a result of possibly setting forth a lawsuit against their employer. These further benefits are unique for each lawsuit.
